Child Support

Child support is designed to provide support to the custodial parent. It is based on the income of both parties as well as other factors, including health insurance and daycare costs. If you find yourself facing a child support issue, either paying or receiving, it is important that you hire an attorney that understands the Alabama child support guidelines and can help you be sure that the child support order is fair and equitable under the law and the specific circumstances of your situation.

Our lawyers can assist you with establishing child support or modifying child support, depending on your specific situation. Our lawyers routinely handle child support establishment, child support modifications, and family law issues in Madison County, Limestone County, Morgan County, Marshall County, and Jackson County. If you need assistance with a child support issue, please contact us to schedule a consultation with one of our Huntsville child support lawyers.

Child Support Modifications

A parent may request a modification of child support at any time after an initial child support order has been entered by the Court. Whether you are requesting an upward modification in the amount received or a downward modification in the amount paid, the parent petitioning the Court has the burden of proving a material change in circumstances.

The Court will typically recognize a change in circumstances when the previous amount paid and the new calculation varies by at least 10 percent due to factors such as an increase or decrease in income. A 10 percent change does not, however, indicate an automatic change in child support obligations. Contact Hodges Trial Lawyers if you have had a change in circumstances which affects child support.
